Defience, Inc d/b/a Acadia (the "Company") is committed to maintaining robust privacy protections for its users. Our Privacy Policy ("Privacy Policy") is designed to help you understand how we collect, use and safeguard the information you provide to us and to assist you in making informed decisions when using our Site.

For purposes of this Privacy Policy, "Site" refers to the Company's website, which can be accessed at www.acadiahealth.ai. The terms "we," "us," and "our" refer to the Company. "You" refers to you, as a user of our Site.

By accessing our Site, you are acknowledging that you have read and accept the terms of our Privacy Policy, and you consent to our collection, storage, use and disclosure of your Personal Information as described in this Privacy Policy.

I. Information We Collect

This Privacy Policy applies to personal data that the Company collects from users of the Company's Site ("Personal Information"). The term "Personal Information" includes any information that can be used on its own or with other information in combination to identify or contact one of our users.

1. Information collected via Technology

In an effort to improve the quality of the Site, we track and may use any information provided to us by your browser when you view or use the Site. Examples of such information include but are not limited to the website you came from (known as the "referring URL"), the type of browser you use, the device from which you connected to the Site, IP address (or proxy server), location, internet service provider and/or mobile carrier, the time and date of access, how and when you interact with various features or functions of our Site, data captured through session replay software, and other information.

We use common information-gathering tools, such as log files, cookies, web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs), and similar technologies to automatically collect information, which may contain Personal Information from your computer or mobile device as you navigate our Site or emails or other communications we have sent you. Cookies are small text files which include an anonymous unique identifier. Cookies are sent to a user's browser from our servers and are stored on the user's computer hard drive. Sending a cookie to a user's browser enables us to collect information about that user and keep a record of the user's preferences when utilizing our services, both on an individual and aggregate basis. The Company may use both persistent and session cookies; persistent cookies remain on your computer after you close your session and until you delete them, while session cookies expire when you close your browser.

If you prefer, you can usually choose to set your browser to remove cookies and reject cookies. Some web browsers may transmit do not track ("DNT") signals to websites with which the user communicates. To date, there is no industry standard for DNT and users cannot know how a given company responds to a DNT signal they receive from browsers. The Company is committed to remaining apprised of DNT standards. However, the Company does not support DNT browser settings and does not currently participate in any DNT frameworks that would allow the Company to respond to signals or other mechanisms regarding the collection of your personal information.

2. Information you provide us

In addition to the information provided automatically by your browser when you visit the Site, we collect Personal Information from users who call our phone number, email us, or fill out a form or submit information on the Site, which data may include, but not be limited to, name, phone number, organization, job title, location and email address. By submitting a form to us through the Site, you are authorizing us to collect, store and use your email address in accordance with this Privacy Policy.

3. Children's Privacy

The Site is not directed to anyone under the age of 18. The Site does not knowingly collect or solicit information from anyone under the age of 18. In the event that we learn that we have gathered personal information from anyone under the age of 18 without the consent of a parent or guardian, we will delete that information as soon as possible. II. How We Use and Share Information

The Company processes your Personal Information based on legitimate business interests, the provision of our Site to you, compliance with our legal obligations, and/or your consent. More specifically, the Company may use your Personal Information for the following purposes:

  • To communicate with you about our products and services;
  • To properly store and track your data within our system;
  • For the purpose for which you have provided it to us, as indicated on the form that you fill out and/or questions that you answer;
  • To protect our rights, privacy, safety, or property, and/or that of you or others by providing proper notices, pursuing available legal remedies, and acting to limit our damages;
  • To enforce and ensure your compliance with our Terms of Use or the terms of any other applicable services agreement we have with you;
  • To manage and improve our operations and the Site, including the development of additional functionality;
  • To identify usage trends, and improve your user experience;
  • To find and prevent fraud, and keep our Site safe and secure;
  • To send you information about changes to our terms, conditions, and policies;
  • To comply with obligations under applicable privacy laws;
  • To allow us to pursue available remedies or limit the damages that we may sustain; and

We may share your personal information with the following categories of individuals/entities:

  • Business partners and vendors who are performing services for the Company. Those vendors use your Personal Information only at our direction and in accordance with our Privacy Policy. Business Partners' use of Personal Information may include, but is not limited to, the provision of services such as data hosting, user interface elements and IT services.
  • We may share your Personal Information with third parties that provide advisory services to the Company, including, but not limited to, our lawyers, auditors, accountants, and banks (collectively, "Advisors"). Personal Information will only be shared with Advisors if the Company has a legitimate business interest in the sharing of such data.
  • In the event we undergo a business transaction such as a merger, acquisition by another company, or sale of all or a portion of our assets, your Personal Information may be among the assets transferred. You acknowledge and consent that such transfers may occur and are permitted by this Privacy Policy, and that any acquirer of our assets may continue to process your Personal Information as set forth in this Privacy Policy subject to applicable law and, where required by law, obtain your consent.
  • We may share Personal Information with outside parties if we have a good-faith belief that access, use, preservation or disclosure of the information is reasonably necessary to meet any applicable legal process or enforceable governmental request; to enforce applicable Terms of Service, including investigation of potential violations; address fraud, security or technical concerns; or to protect against harm to the rights, property, or safety of our users or the public as required or permitted by law.
  • We may disclose your Personal Information for any other purpose with your consent.

The Company uses third-party service providers to monitor and analyze the use of the Site. The third-party vendors we use may include but are not limited to: Web3Forms (operated by Web3Creative), Google (including Google Analytics and reCAPTCHA), Amazon Web Services (AWS), Chatbase, and Apollo.io (ZenLeads Inc.).

III. How We Protect Information

We implement reasonable security measures designed to (i) protect your information from unauthorized access and use; (ii) maintain the security and integrity of your Personal Information; and (iii) protect against any threats or hazards to the security or integrity of your Personal Information. However, these measures do not guarantee that your information will not be accessed, disclosed, altered or destroyed by breach. By using our Site, you acknowledge that you understand and agree to assume these risks.

While the Company uses reasonable security controls, WE CANNOT GUARANTEE OR WARRANT THAT SUCH TECHNIQUES WILL PREVENT UNAUTHORIZED ACCESS TO YOUR PERSONAL INFORMATION. THE COMPANY IS UNABLE TO GUARANTEE THE SECURITY OR INTEGRITY OF PERSONAL INFORMATION TRANSMITTED OVER THE INTERNET, AND THERE IS NO GUARANTEE THAT YOUR PERSONAL INFORMATION WILL NOT BE ACCESSED, DISCLOSED, ALTERED, OR DESTROYED BY BREACH OF ANY OF OUR PHYSICAL, TECHNICAL, OR ADMINISTRATIVE SAFEGUARDS. ACCORDINGLY, WE DO NOT AND CANNOT ENSURE OR WARRANT THE SECURITY OR INTEGRITY OF ANY PERSONAL INFORMATION YOU TRANSMIT TO US. YOU ASSUME THE RISK THAT UNAUTHORIZED ENTRY OR USE, HARDWARE OR SOFTWARE FAILURE, AND OTHER FACTORS MAY COMPROMISE THE SECURITY OF YOUR PERSONAL INFORMATION AT ANY TIME.

The Company retains your Personal Information only if necessary and as required for our business operations, the provision of the Site or services, archival purposes, and/or to satisfy legal requirements. The exact period of retention (the "Retention Period") will depend on: (i) the amount, nature, and sensitivity of the Personal Information; (ii) the personal risk of harm for unauthorized use or disclosure; (iii) the purposes for which we process your Personal Information, including whether those purposes can be achieved through other means; and (iv) business operations and legal requirements.

The Company and its Business Partners reserve the right to continue using de-identified data indefinitely, even after Personal Information has been removed from the Company's databases. We may continue to disclose de-identified data to third parties in a manner that does not reveal personal information, as described in this Privacy Policy. Our continued use of de-identified data will comport with applicable law.

IV. Your Rights Regarding the Use of Your Personal Information

You have the right at any time to prevent us from contacting you for marketing purposes. When we send a promotional communication to a user, the user can opt out of further promotional communications by following the unsubscribe instructions provided in each promotional e-mail. Please note that notwithstanding the promotional preferences you indicate by either unsubscribing or opting out in each e-mail, we may continue to send you administrative emails including, for example, periodic updates to our Privacy Policy.

You have certain rights relating to your Personal Information. These rights are subject to local data protection and privacy laws, and may include the right to:

  • Access Personal Information held by the Company;
  • Erase/delete your Personal Information, to the extent permitted by applicable data protection and privacy laws and to the extent technologically feasible;
  • Receive communications related to the processing of your Personal Information;
  • Restrict the processing of your Personal Information to the extent permitted by law;
  • Object to the further processing of your Personal Information, including the right to object to marketing;
  • Request that your Personal Information be transferred to a third party, if possible;
  • Receive your Personal Information in a structured, commonly used, and machine-readable format; and/or
  • Rectify inaccurate personal information and, considering the purpose of processing the Personal Information, ensure it is complete.

If at any point you no longer agree to the use and disclosure of Personal Information, as described in this Privacy Policy, discontinue all further use of the Site and send a deletion request to support@acadia.xyz with the following information:

  • The email address, phone number and/or name you shared with us previously; and
  • A statement that you are requesting Personal Information deletion.

Once we have deleted your Personal Information, we will provide confirmation to you via email.

VI. Changes to Our Privacy Policy

The Company reserves the right to change this Privacy Policy at any time. Any revisions to the Privacy Policy will be posted on the Site. Any changes to this Privacy Policy will be effective immediately upon posting a new version of the Privacy Policy on our Site. We will change the "Last Updated" date above and the changes will apply to all Personal Information that we maintain, use, and disclose. If you continue to use the Site following such posting, you are agreeing to those changes.
